Acceptance of Terms
By accessing or using Fruityo ("Service"), operated by Juraj Miškech ml. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 16 years of age and have the legal capacity to enter into these Terms.
Description of Service
Fruityo is an AI-powered video generation platform that allows users to create videos using artificial intelligence technology. The Service includes:
- AI video generation from text prompts and images
- Text-to-speech synthesis for video narration
- Lip-sync technology for realistic video output
- Access to a library of AI actors and templates
- Video storage and download capabilities
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
User Accounts
To access certain features of the Service, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.
Acceptable Use Policy
You agree not to use the Service to create, upload, or distribute content that:
- Is illegal, harmful, threatening, abusive, harassing, or defamatory
- Contains sexually explicit or pornographic material
- Promotes violence, discrimination, or hatred against any individual or group
- Infringes on any third party's intellectual property rights
- Impersonates any person or entity without their consent
- Creates deepfakes or misleading content intended to deceive
- Spreads misinformation or disinformation
- Violates any applicable local, national, or international law
We reserve the right to remove any content that violates these guidelines and may terminate accounts that repeatedly violate this policy.
Payment Terms
Subscription Plans
Access to certain features requires a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. Subscription fees are billed in advance on a recurring basis according to your selected plan.
Credit System
Video generation is based on a credit system. Credits are consumed when you generate videos and do not expire during an active subscription. Unused credits do not roll over to the next billing period unless otherwise specified in your plan.
Refunds
Subscription fees are generally non-refundable. However, if you experience technical issues that prevent you from using the Service, please contact us within 14 days of your payment, and we will work with you to resolve the issue or provide a refund at our discretion.
Price Changes
We reserve the right to change our prices at any time. Any price changes will be communicated to you in advance and will take effect at the start of your next billing cycle.
Intellectual Property
Our Content
The Service, including its original content, features, functionality, AI models, and branding, is owned by Fruityo and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of our content without explicit permission.
Your Content
You retain ownership of any content you provide to the Service (text, images, etc.). By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service to you. Videos generated using your content belong to you, subject to our AI actors' usage rights.
AI Actor Usage
The AI actors provided in the Service are licensed for use in videos generated through our platform. You may use the generated videos for personal and commercial purposes in accordance with your subscription plan. You may not use AI actor likenesses to create harmful, misleading, or inappropriate content.
Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind
- We do not guarantee that the Service will be uninterrupted, secure, or error-free
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for the accuracy or quality of AI-generated content
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so these limitations may not apply to you.
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:
- Violation of these Terms
- Violation of our Acceptable Use Policy
- Non-payment of fees
- Fraudulent or illegal activity
- Upon your request to delete your account
Upon termination, your right to use the Service will cease immediately. You may download your generated content before account deletion. We may retain certain information as required by law or for legitimate business purposes.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Slovakia, without regard to its conflict of law provisions. For users in the European Union, nothing in these Terms shall affect your statutory rights under applicable EU consumer protection laws.
Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Slovakia, unless mandatory consumer protection laws provide otherwise.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
